Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FloatPesa platform, mobile applications, APIs, and related services (collectively, the "Services"). By creating an account or by otherwise using the Services, you agree to be bound by these Terms and all referenced policies, including our Privacy Policy.

If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

FloatPesa provides tools for licensed mobile money agents, super agents, and financial institutions. You must complete all onboarding, KYC, and compliance checks requested by FloatPesa and our banking partners before activating your account.

We may decline or suspend access if the required information is incomplete, inaccurate, or if risk assessments suggest that onboarding would contravene regulatory obligations.

You agree to use the Services only for lawful purposes and in accordance with applicable laws, regulations, and operator agreements. You must not:

• Circumvent platform security or attempt unauthorised access to other accounts.
• Submit fraudulent, misleading, or inaccurate transactions or records.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the Services.
• Use the Services in a way that could damage, disable, or overburden FloatPesa infrastructure.

FloatPesa may monitor usage to ensure compliance and reserves the right to suspend or terminate access for violations.

Certain features may involve fees, commissions, or spread charges communicated during onboarding or before each transaction. You are responsible for reviewing and agreeing to the applicable pricing before submitting transactions.

Float balances, reimbursements, and settlements are subject to processing times of our banking partners and mobile network operators. FloatPesa is not liable for delays outside our direct control.

FloatPesa processes data in line with our Privacy Policy. By using the Services, you grant FloatPesa permission to use operational data to deliver the Services, improve functionality, and comply with legal requirements.

You must keep all credentials, API keys, and security information confidential and promptly notify FloatPesa of any unauthorised access.

All software, trademarks, content, and materials provided through the Services are owned by or licensed to FloatPesa. You receive a limited, non-exclusive, non-transferable licence to use the Services as provided. You may not reproduce, modify, or create derivative works without prior written consent.

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FloatPesa disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free operation and are not responsible for failures arising from third-party systems, telecommunications, or force majeure events.

To the maximum extent permitted by law, FloatPesa and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the fees paid to FloatPesa in the three (3) months preceding the event giving rise to the claim.

Either party may terminate these Terms with thirty (30) days' written notice. FloatPesa may suspend or terminate access immediately if you breach these Terms, violate applicable law, or pose a risk to other users or to the platform.

Upon termination, your right to access the Services ends, but sections that by their nature should survive shall remain in effect (including confidentiality, intellectual property, disclaimers, and limitations of liability).

These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising out of or in connection with the Services shall be subject to the exclusive jurisdiction of the courts of Tanzania.

Before initiating formal proceedings, the parties agree to attempt good-faith negotiations to resolve disputes within thirty (30) days.

We may update these Terms to reflect new features, regulatory requirements, or operational adjustments. We will notify you of material changes through the platform or by email. Continued use of the Services after updates take effect constitutes acceptance of the revised Terms.
